Two suspects were taken into custody by the Estes Park Police Department on Sept. 26 in connection with the shoot that occurred in Estes Park on July 28 at approximately 7:10 p.m. near the intersection of Stanley Avenue and U.S. Highway 36.

The arrests were made in the Thornton Police Department’s jurisdiction and the EPPD was assisted by the Thornton PD with a search and arrest warrant service.

The suspects are Scott Lee Custer, 18 of Thornton and Donivan Josiah Nanez, also 18, of Thornton.

Custer was charged with attempted first-degree murder, CRS 18-3-102(1)(d), a class 2 felony. Bail was set at $500,000. Custer is currently in custody in the Adams County Detention Facility in Brighton. His case number is 2024CR1478 and his first court appearance is scheduled for Oct. 16 at 8:30 a.m. in Court Room 3 of the Larimer County Court House.

Nanez was charged with harassment, CRS 18-9-111(1)(a), a class 1 misdemeanor. He was booked and released. His case number is 2024M1227 and his in-person arraignment is scheduled for Oct. 21 at 8:30 a.m. in Court Room 1 of the Larimer County Court House.

Both suspects are presumed innocent until proven guilty in a court of law.
